Whatever happened to the pocket veto?

From the U.S. Constitution Article 1, Section 7:
"...If any Bill shall not be returned by the President within ten Days (Sundays excepted) after it shall have been presented to him, the Same shall be a Law, in like Manner as if he had signed it, unless the Congress by their Adjournment prevent its Return, in which Case it shall not be a Law. "The Military Commissions Act of 2006 (you know, the one that eliminates habeas corpus) was passed by Congress in late September. They adjourned right after that. As of today, the president has not yet signed the bill.
What's up with that?
The only urgency was the risk that the lame duck session wouldn't be as easily bullied, and it'll never pass the new Congress in January.
From what I understand, it's held up on a technicality. The House clerk (who just resigned, but that's another story) hasn't officially signed, sealed and delivered the approved bill to the White House. (Yes, that signed, seal and delivered thingy still means something.)
